How to Adopt

An adoptive home is the final piece of the puzzle for our rescued horses that have been through so much! Toby's Legacy takes great care to ensure a good match is made between the adoptive family and horse. Personalities and temperaments, rider abilities and working goals for the horse are all taken into consideration. Adoption Agreement

Upon receipt of Adopter’s signed agreement and covenant to provide all necessary care for said equine, Toby’s Legacy Equine Rescue, Inc. hereby transfers custody of said equine to Adopter for the remainder of the equine’s life or until such time as Adopter cannot or will not continue such care for said equine. In either of the latter instances, adopter shall notify Toby’s Legacy Equine Rescue, Inc., who has first right of refusal in accepting the horse back. If Toby’s Legacy Equine Rescue, Inc. is not able to take the horse back, adopter will be allowed to find it another acceptable loving and qualified home, under an adoption contract with Toby’s Legacy Equine Rescue, Inc. at their approval of the new adopter. It is clearly understood and agreed that Adopter has no right to sell, transfer, lease, or convey possession and/or ownership of said equine to any other individual or entity at any time for any reason.  Under no circumstances should the equine be bred, sent to auction or slaughter.

Hold harmless and indemnity
Adopter agrees to hold Toby’s Legacy Equine Rescue, Inc. an harmless against any and all personal and property injury stemming from the adoption to any and all parties including but not limited to the adopter, their family, friends, or visitors including all medical, emotional, or other such injuries or damages. Adopter will indemnify Toby’s Legacy Equine Rescue, Inc., agents, employees, contractors, suppliers and its owners against such injury or damages and pay all court, and/or accident investigation costs which includes but not limited to defense costs. All such costs shall be paid by adopter within thirty days of invoice.

Inspection of Records
At anytime and by unilateral action, Toby’s Legacy Equine Rescue, Inc. may inspect during normal business hours any record or document associated with the adopted horse including email, receipts, or phone records in order to determine the health, maintenance of the horse or to determine the cause of any injury including personal or property damage to any party

THIS AGREEMENT IS NOT AN AGREEMENT OF SALE BUT IS AN AGREEMENT OF POSSESSION.

Adopter shall provide all food, water, shelter, farrier, and veterinary care as is necessary to maintain said equine in good health and safety and shall provide a quality environment free of abuse, neglect, poor handling and/or mismanagement for remainder of said equine’s lifetime.  Adopter shall keep Toby’s Legacy Equine Rescue, Inc. informed of all changes to name (both equine and Adopter), address, phone and status of said equine necessary to insure the protection of said equine and to enforce the provisions hereof.

Toby’s Legacy Equine Rescue, Inc. retains the right to inspect any facility where said equine is kept at its discretion and without notice.  If assigned agents associated with Toby’s Legacy Equine Rescue, Inc. determine that abuse or neglect exist, they retain the unilateral right to repossess said equine immediately or at such time as may be required by the circumstances.  Should Toby’s Legacy Equine Rescue, Inc. fail to immediately repossess the subject equine upon findings of abuse and/or neglect, such failure does not constitute a waiver of its right to do subsequently.

Should harm and/or death of said equine result from any act of omission, neglect or otherwise preventable situation, Adopter shall be liable therefore.  If reasonable medical intervention is necessary to save the life of said equine and the cost thereof is prohibitive to the Adopter, Toby’s Legacy Equine Rescue, Inc. shall be contacted for available assistance.

Adopter is to notify Toby’s Legacy Equine Rescue, Inc. in any instance of severe medical problems and injuries of said equine.

Adopter is to provide name, address and phone number of Adopter’s primary veterinarian and farrier. Adopter releases the right to Toby’s Legacy Equine Rescue, Inc. to contact the primary veterinarian and farrier at any given time to obtain any and all records kept on said equine.

Adopter shall notify Toby’s Legacy Equine Rescue, Inc. within 24 hours of said equine’s death, and must provide Toby’s Legacy Equine Rescue, Inc. with a death certificate, fully explaining the cause of said equine’s death, and signed by a veterinarian, to Toby’s Legacy Equine Rescue, Inc. within 7 days of death.

The Adopter understands that the Adopted Animal may have health limitations due to previous instances of abuse or neglect. Toby’s Legacy Equine Rescue, Inc. hereby provides the Adopter with the health records of the Adopted Animal that were known to Toby’s Legacy Equine Rescue, Inc. at and/or after the time Toby’s Legacy Equine Rescue, Inc. obtained possession of the Adopted Animal, and the specially required medications and nutritional needs of the Adopted Animal. Toby’s Legacy Equine Rescue, Inc. and the Adopter agree that Toby’s Legacy Equine Rescue, Inc. makes the following disclosures as a courtesy to the Adopter and these disclosures are merely opinions. Nothing herein shall be construed as a claim, representation or warranty as to the temperament, health or mental disposition of the Adopted Animal.

Limitations as to riding the Adopted Animal.  
The Adopter understands that there may be limitations as to the type of riding appropriate for the Adopted Animal. The Adopter agrees to ride the Adopted Animal only in accordance with those limitations in order to ensure that there will be no additional injuries to the Adopted Animal or injuries to the Adopter. 

Adopter will be asked to provide the name, address, and phone number of the boarding stable where the adopted animal will be kept if he/she will not be kept at your residence. Adopter releases the right to Toby’s Legacy Equine Rescue, Inc. to contact the boarding facility for any information regarding the adopted horse.

The Adopter understands that a non-refundable adoption donation will be paid to Toby’s Legacy Equine Rescue, Inc. by Adopter.  This adoption donation must be paid in full before the Adopted Animal is removed from  Toby’s Legacy Equine Rescue, Inc.'s premises, unless a financial agreement otherwise has been agreed to by Toby’s Legacy Equine Rescue, Inc. and attached to this Agreement.  This donation may be tax deductible by the Adopter.  The Adopter should consult his/her independent tax advisor to determine deductibility.  The Adopter is responsible for transportation of the adopted equine.  If available, transport arrangements can be made at the rate of $1.00 per mile.
